FILM AND PROGRAM PRODUCER - COPYRIGHT INFRINGEMENT

A film and program producer was sued for its television documentary which contained footage of a videotape that the plaintiff alleged had been produced by, and subject to copyright protection for, the plaintiff. The case was dismissed on summary judgment, but not before legal fees of a considerable amount were incurred in defending the case.

A film and program producer was sued by a politician who claimed that his speeches were copyrighted and could not be used without his permission. The documentary in question contained excerpts from a number of speeches of the plaintiff and was broadcast on national television, as well as being sold as a videotape. The case eventually settled for an above average amount. Legal fees to defend the case were approximately four times as much as the settlement amount.

FILM AND PROGRAM PRODUCER - ERRORS AND OMISSIONS

A West Coast videotape manufacturer was sued on the basis that a children's tape contained pornographic film by mistake. The plaintiff claimed that her children suffered emotional injury as a result of viewing the film. Negligence was among the causes of action alleged. The suit was for damages for psychological and emotional harm allegedly suffered by the children from viewing the tape in question. The case was defended and eventually dismissed. Legal fees were of an above average amount.
